Please carefully read this Privacy Policy before accessing the website located at www.PlanBkw.com (“the Website”) and/or the PlanB mobile application available for download at Google Play Store and Apple App Store (“the App”). The Website and the App are hereinafter collectively referred to as the “Platform”. The Platform is controlled by Plan B AlKuwait P.L.C (registration no. 448476) in accordance with the laws of the State of Kuwait (hereinafter the “Company,” “we,” “us”, or “our”).
This Privacy Policy informs you how we collect, use, share and secure your personal data when you use the Platform and your rights as a data subject. We are the data controller of all personal data processed on the Platform, and we will not process your personal data except as described hereunder. By signing up for a user account, you agree to processing your personal data in accordance with this Privacy Policy. If you do not agree with any provision of this Privacy Policy, please do not access the Platform.

Who is covered by this Privacy Policy?
This Privacy Policy covers individuals who sign-up for a user account and those who subscribe to our mailing list.

Unless expressly defined otherwise in our Terms and Conditions, the following words shall have the meaning as defined below:
Account Holder
refers to a Buyer or Seller who registers a User Account on the Platform.
Data Controller
means a natural or legal person who, either alone or jointly with others, determines the purpose for which any personal data that is collected is processed and the means of processing such personal data.
Personal Data
means any information about a natural person who can be identified, directly or indirectly, from that information.
Data Subject
refers to any individual who accesses/uses the Platform and whose personal data is processed by the Company and its processors.
User
refers to an account holder on the Platform.
User Account
means the account provided by the Company to a user, which enables the user to securely log in to the Platform
and make use of the features and functionality.

What type of data do we collect, and how do we use it?
We collect several different types of data from you for different purposes, including:

By default, all user accounts are registered as Buyer accounts on the Platform. When you sign up for the user account, the personal data we collect includes
your full name, email address, and mobile number (hereinafter “Buyer Account Data”).
Why do we process the Buyer Account Data? We process the Buyer Account Data to:

Enable you to sign in to your account;

Enable you to:

Post your Buyer Requests;

Communicate with Sellers;

Place Orders and pay for them securely through the Platform; and

Leave ratings and reviews for your experience;

Legal basis for processing ‘Buyer Account Data’
We rely upon the performance of a contract as our legal basis for processing your Buyer Account Data.
Retention Period
We retain your Buyer Account Data for up to five years after the termination of the user account. At the end of the five year period, we will remove all user account data. Please note that we reserve the right to retain any user account data by anonymising it so it cannot be linked back to the user. Please note that we may be allowed to keep a user’s account data for a longer duration on other lawful grounds.

When you apply for a Seller account, you will be requested to provide us with some additional information such as your personal identification document, your Upayments account data, and other optional information such as your qualifications, skills and past work experience (hereinafter “Seller Account Data”).
Why do we process the Seller Account Data?
We process the Seller Account Data for purposes including but not limited to:

Enabling you to create a Seller Profile and switch between Buyer and Seller account;

Suggesting your Seller Profiles to prospective Buyers;

Enabling you to view Buyer Requests, communicate with Buyers, including accepting, rejecting Orders and receiving Payments for those Orders; and

Contacting you as and when needed.
Legal basis for processing Profile Data
We rely upon the performance of a contract as our legal basis for processing your Seller Account Data.
Retention Period
We retain your Seller Account Data for up to five years after the termination of your user account. At the end of the five years, we will remove all data associated with your Seller Account except any such data that we must retain for our legal compliance and accounting purposes. We may be allowed to keep your Seller Account Data for a longer duration on other lawful grounds.

When users place an Order through the Platform, we receive certain information about the commercial transaction between the parties, including the Freelance Services acquired, the Order amount, the Buyer’s preferred mode of payment, and the content of the Rating and Review. Please note that we do not collect or process any payment data, which will be collected and processed directly by our payment processor.
Why do we process ‘Order Data’?
We process Order Data for purposes including but not limited to:

Processing the Order payment, including billing the Buyer’s payment method and transferring the revenue to the Seller’s account;

To resolve Order related disputes; and

To detect and prevent fraudulent activities.
Legal basis for processing contract data
We rely upon the performance of a contract to which the data subject is a party as the legal basis for processing the Order data.
Retention Period
We may retain Order data for up to five years after the termination of the user’s account. At the end of these five years, we will delete all Order data, or we may continue to retain it by anonymising it so it cannot be linked back to any individual.

The Company also receives personal data directly from a user when a user sends a support request to the PlanB customer support team (“Support data”). Support data may include a user’s name, email address, phone number and the content of the message. Support data may also include any other personal data requested by the Company in order to service a user’s support request.
Why do we process ‘support data’?
We process this data to understand and service a user’s support request and follow up with the user if required.
Legal basis for processing support data
We rely on our legitimate interests, which do not override a user’s data rights, as our legal basis for processing this data.
Retention Period
We will retain the support data for up to six months after the termination of your user account. We may retain the content of the support request message by anonymising it for our internal business purposes.
We automatically collect certain personal data from our users’ use of the Platform, including but not limited to the pages a user has viewed, the date and time of users’ visits, the time you spend on the Platform, IP address, browser type and version, hardware model of the device, location settings and other similar data.
Why do we process usage data?
We process this data to improve our understanding of how our users use the Platform, improve our Platform and your user experience, detect and prevent any fraudulent activities, and guide our development initiatives and other similar purposes.
Legal basis for processing support data
We rely upon our legitimate interests as our legal basis for processing this usage data.

Do we share your personal data?
We respect your personal data, and we only share your personal data as described hereunder:

The Platform enables Sellers and Buyers to connect, communicate, and transact with each other. This requires the Platform to make some publicly visible information about our users accessible to other Platform users.

Third-Party Service Providers
We may share and disclose your personal data with third-party service providers that we engage during the performance of our business operations, such as web hosting, payment processing, email distribution, marketing and customer support services. For the avoidance of any doubt, we will only disclose your personal information that is necessary for our Service Providers
to perform their functions on our behalf. Our Service Providers will only use your personal data as authorised by us. In no event will they be allowed to use it for any purpose other than those specified in this Privacy Policy.

If in the future, we buy a business or are acquired by another business, our users’ personal data may be disclosed to the new entity as part of due diligence and transferred as part of the commercial transaction. We assure you that in the event of any such changes in ownership, your personal data will continue to be governed by this Privacy Policy, except in cases where you expressly consent otherwise.

In some circumstances, we may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities.

To protect ourselves or our users
We will disclose your personal data to enforce our Agreement with you, defend ourselves in legal actions, or protect our users or others from threats posed by your actions, including but not limited to sharing your data with other organisations as part of fraud protection.

Our Platform is designed with the security of data in mind. We only transmit your data using encryption protocols. We use a secure third-party payment processor to collect and process our users’ payment data, so none of the sensitive financial data is collected or stored on our database. We also restrict access to data within our Company on a need to know basis to prevent unauthorised access. All user accounts are password-protected, and we restrict the use of an account by multiple users.
Regardless of the security measures, we have put in place; you acknowledge that the transmission of data over the internet is never one hundred per cent secure. Accordingly, we cannot offer any guarantees regarding the absolute security of your personal data.

You have the right to access and edit the personal information that we hold for you. You can exercise your right by signing in to your user account on the Platform or sending us a data subject request. In some circumstances, you may also request the deletion of your personal data. Where our legal basis for processing your personal data is your consent, you have the right to withdraw your consent. You can send your

We are committed to protecting children’s privacy. The Platform does not allow users under the age of 18 years to sign up for a user account. If you believe that a child has provided his/her personal information to us, please contact us, and we will investigate the matter and take appropriate action.

The Platform may contain links to third-party websites that are not owned or operated by us. Should you decide to click on any such third-party links, you will be directed to such a third party’s website. These third-party websites are governed by their own Terms and Conditions and Privacy Policy. We encourage our users to review the third-party Terms and Privacy Policy before using such services. The presence of any third-party links on our Platform does not constitute an endorsement or recommendation of such a third party, and we cannot be held responsible for such a third party’s actions.

From time to time, we may amend this Privacy Policy to reflect our new privacy practices and commitment to compliance with applicable privacy laws and regulations. We will post the updated Privacy Policy on this page and notify you of such updates by changing the last updated date on the top or by sending an email.
